It’s not so much that they have a dream to get their real estate license, it’s more that they have a dream to quit their job and start making a million dollars selling real estate and have a lot more free time and vacations at the same time.

Only about half of the applicants pass their state exam every year. Florida is welcoming about 27,000 to 28,000 new Real Estate Sales Associates every year.

At the end of 2019, there were about 201,300 active Sales Associate licensees, 81,000 voluntary inactive Sales Associate licensees, 22,000 involuntary inactive Sales Associate licensees, 21,600 active Broker Associate licensees, 5,500 voluntary inactive Broker Associate licensees, 1,700 involuntary inactive Broker Associate licensees, 30,000 individual active Broker licensees, and 3,200 voluntary. inactive Broker licensees.

This is approximately 366,300 individuals who have real estate licenses and are trying to get prospects and customers. If you believe in the 80-20 rule or the Pareto Principle, this now means that only about 73,000 to 74,000 or 20% will actually do anything significant and make real money. 


Are there any common factors to their success? YES! 


Here are the 5 most important factors to your success in Real Estate.  


1. You must have Goals Write down your goals. 


At the very least, you want 1-year goals and 90-day goals. If you do not know where you are going, you will end up somewhere and it will probably not be where you wanted nor intended. Hint: ‘More money’ is not a goal, it is a wish. 


After this, try creating and writing down your 5-year goals. Ask yourself a question: Think about where you are right now with your life. Where do you really want to be in 5 years? It is tough facing your own reality, but it will be worth it. 


2. You must have a Plan You must have a written Business Plan that maps out your steps on a daily and weekly basis. Hourly is preferred. You get so much more done when you know exactly what you are going to do that will get you to where you want to go. 


3. You must have Training Even though The Climer School of Real Estate is the very best at training our students to pass the Florida Real Estate State Exam on their first try, we tell all of our pre-license real estate class students that we are not teaching them anything about the real estate business and actually making money. You have to have training. It is surprising how little people really know after their real estate pre-license class. 


4. You must have Inner Commitment and Perseverance This is the one factor that cannot be measured. It is possibly the most important factor to success. Intelligence, brains, strength, looks, athletic talent, musical ability; none of these are as important as Commitment and Perseverance. 


Only you know the depths and level of these two things inside of you. No matter what, do not quit. 


5. You must have Inner Positive Energy and Thoughts Positive energy and thoughts attract positive things and people into your sphere and life. If you are a negative person inside, smiling on the outside will not change your inner energy. 


If you are angry, hurt, distrustful, mean, hurtful, feel entitled, and so on; you may want to see a therapist and do what you can to purge the hurts and negativity that is residing inside you. 


Nothing will change if you do not. Everything will change if you do.

The Department of Business and Professional Regulation (DBPR) and Pearson Vue have released the Pass-Fail Performance Numbers for May and June 2020 for the Florida Real Estate Sales Associate License State Exam.


First, if you are thinking about getting your Brokers License, The Climer School of Real Estate is starting a Brokers Pre-License Class August 17th, 2020. Andy Brown will be teaching this class. This is the best Brokers License Class in Florida and there is a waiting list.

As the Owner and the Permit Holder for The Climer School of Real Estate, I receive the Pearson Vue, Bureau of Education and Testing Division of Real Estate’s Monthly Exam Performance Summary every month.


Unfortunately for many Real Estate license test takers the news is bad again. The Passing rates are still low, and the Failure rates are still high. Oddly enough, even during the COVID-19 Quarantine Super Low Numbers Shutdown Month of June, the percentages remained the same.


These numbers just prove my belief that the state exam question writers are working harder at tricking you into a wrong answer and in failing test takers than they are in testing your knowledge.


If I could change this, I would. Since I cannot, I work with what they give me. May 2020 Exam Performance Summary


In May of 2020 1,244 individuals took the Florida Real Estate exam for the first time. Of this number, only 788 of them passed while 456 of them failed.


This is a passing rate of 63% and a failing rate of 37%.
Only 551 took the same Real Estate test for a second or for a repeated time. Only 175 of them passed while 376 of them failed.


This is a pass rate of 32% and a fail rate of 68%. Same as usual - terrible.

May 2020 Brokers License Exam Performance Summary


Brokers applicants did not do much better. In May 2020, 141 took the Florida broker’s license state test for the first time. Of this number, 88 of them passed and 54 of them failed.


This is a passing rate of 69% and a failing rate of 31%.
57 people took the Florida broker’s license state exam for a second or for a repeated time.

Only 23 of them passed while 56 of them failed.
This is a pass rate of 38% and a fail rate of 34%.

In June of 2020, 1,646 individuals took the Florida Real Estate exam for the first time. Of this number, only 1,015 of them passed while 631 of them failed.


This is a passing rate of 62% and a failing rate of 38%.


1,090 took the same Real Estate test for a second or for a repeated time. Only 436 of them passed while 654 of them failed.


This is a pass rate of 40% and a fail rate of 60%.

June 2020 Brokers License Exam Performance Summary


In June 2020, 161 managed to take the Florida broker’s license state test for the first time. Of this number, 105 of them passed and 56 of them failed.


This is a passing rate of 65% and a failing rate of 35%.
109 people took the Florida broker’s license state exam for a second or for a repeated time. 44 of them passed and 65 of them failed.


This is a passing rate of 40% and a failing rate of 60%.

The 2019 DBPR Florida Real Estate License Numbers


This is a Little Misleading

Only 264,157 were Active

Probably more like 254,000 Individuals due to Multiple Broker Licenses

Here’s the good news: You can easily be in the Top ‘20%’ .

First, There lots of classes going on at The Climer School of Real Estate.

We have many Real Estate License classes scheduled throughout central Florida, and in many different schedule formats to meet your needs.

It is also License Renewal Time. Make sure you get your Post 45 completed. Attend one of our Post 45 classes. We provide our students with an extraordinary Post 45 experience.

2019

At the end of calendar year 2019, there were 201,308 active Sales Associate Licensees in Florida and 21,585 active Broker Associate Licensees in Florida. Not counting Brokers, this is a grand total of 222,893 potential competitors.

If you believe in the Pareto Principle or the 80/20 rule, 44,580 Licensees that you need to be concerned with. The Pareto Principle says that 20% of the agents will earn 80% of the income. It also means that 80% of the agents will only earn the remaining 20% of the income. Be in the 20%.

The 2018 DBPR Florida Real Estate License Numbers

At the end of calendar year 2018, there was a grand total of 403,335 Real Estate Licenses in Florida. Of these, there were 192,739 active Sales Associate Licensees in Florida and 21,065 active Broker Associate Licensees in Florida.

Not counting Brokers, this is a grand total of 213,804 potential competitors. Based on the Pareto Principle or the 80/20 rule, 42,760 Licensees that you need to be concerned about.

The Good News is that You are in Florida


Florida has about 1,000 people a day moving into the state. This is good news for you. They all need a place to live. They are going to buy or rent. You just need to figure out your marketing so that you can connect with a few of them a month. You will have it made

The Florida Realtors®

According to the Florida Realtors® website, there are about 187,000 realtors in the state. Again, I believe that the 80/20 rule or the Pareto Principle is in effect. 20% of the agents in this group will be earning 80% of the income and be working with 80% of the transactions. That means that the remaining 80% of the agents in the group are fighting over the remaining 20% of the income and the 20% of the transactions. You can be in the 20%.

Inactive Florida Sales Associate Licenses

Here are some interesting numbers: At the end of calendar year December 2019, there were 80,660 current but inactive Sales Associate Licenses. There were also 21,776 involuntarily inactive Sales Associate Licenses.

 I don’t know if you’re counting but this is a total of 102,436. Over 100,000 inactive Sales Associate Licensees. Wow! All that work is your License just to leave it inactive.

 Just to round out the data, 21 Licensees are on probation, 121 have their Licenses temporarily suspended, and 221 of them are on military inactivity.

Inactive Florida Broker Associate Licenses

5,478 Broker Associates are current but voluntarily inactive. 1,664 to Broker Associates are involuntarily inactive.

If you’re counting, this is 7,142 inactive Broker Associate Licensees.


It sure seems like a lot to me. Three Broker Associate Licensees on probation, six are in suspension, and six are on the military inactivity list.

Inactive Florida Brokers

There are 3,182 Brokers who are current and voluntarily inactive and 2,465 are involuntarily inactive. 10 Brokers are on probation for discipline and 18 Brokers are on temporary suspension. Two are on the military inactive list.

An even crazier fact is that there are 858 Licensed Real Estate Instructors in Florida.

There are also 309 current but inactive Real Estate Instructors and 180 involuntarily inactive Licensed Real Estate Instructors at the moment. There is on on suspension.

FYI, apparently one Instructor is on probation and one is on suspension.

I cannot believe that there are 502 Real Estate schools being tracked by the DBPR in Florida.

Although you already know, this should prove to you again why you have to be careful when you take a Real Estate school. It is too easy to get a Real Estate school License and too easy to get a Real Estate Instructor License.


Too many people get a Real Estate Instructors License or start a school because they think it is easy money or it is a good way to recruit. They have no idea what they’re getting into her what they’re doing.

They are doing a huge disservice to their students.

We have 5 Florida Real Estate Sales Associate Pre-License Classes beginning in February.

We have a 1 Week Class beginning February 4 at our Main Campus in Orlando. This is one of the most popular formats as you are done in one week.

The one week format runs from Monday through Saturday, 8 AM in the morning till 6 PM. Your Class final exam is the next Monday at 6:00 PM.

The address of the Orlando Main Campus is 5104 N. Orange Blossom Trail, Orlando, FL 32810. This Class will be in Suite 103, which is immediately to your left as you walk in the lobby.

We have a two week Class beginning on Monday, February 11. Our popular two week Real Estate Class format runs from Monday through Friday for two weeks in a row.

Our two week Class beginning on Monday, February 11 is also at our Orlando Main Campus. This Class runs from 9 AM in the morning to 3 PM in the afternoon.

We have another two week Class starting on Monday, February 4 at our Waterford Lakes Campus. 

This also runs Monday through Friday for two weeks in a row however this one starts at three in the afternoon and runs until nine in the evening.

By popular request we are experimenting with this five-week format, three days a week, Tuesday through Thursday.

We are starting one of our new five-week Classes at Mount Dora Campus beginning Tuesday, February 19. This Class will be from Tuesday through Thursday, 6 PM to 10 PM, for five weeks.

We are also holding a five week Class at our new East Orlando Campus. This Class will also be Tuesday to Thursday, 9:54 PM, for five weeks.

We are also registering for our Brokers License Real Estate Class beginning Monday, February 11, at our Orlando Main Campus. Our Florida brokers license Class runs over a two week period.

The first week is Monday, Tuesday, and Thursday from 8 AM to 6 PM. The second week is Monday, Tuesday, Thursday, and Friday from 8 AM to 6 PM.

We know our students in the Brokers License Class are working Real Estate agents. We give you a day off break to catch up on your Real Estate business. Additionally it is worth noting that as professional courtesy cell phones are allowed out during this Class. They are on silent and are to allow our students to stay on top of current closings, customers, and leads.

Our students are Florida Real Estate Brokers License Class are expected to behave as professionals, respect the professional courtesy regarding cell phone usage during Class, and not disengage from the Class nor distract other students.

All of our instructors and Pre-License Real Estate Classes utilize our proprietary patent-pending PASS F.A.S.T.™ system and technology. We have a night and weekend Post 45 Class that we are holding in February. This Class begins Friday, February 22. This Class format runs for two weekends. The two Fridays are from 6:00 PM to 9:30 PM and the two Saturday and Sunday Classes are from 8 AM to 5:30 PM.

Customer vs Client in Florida Real Estate

What Are The Differences and Why Is This Important?

Many Florida Real Estate Agents Inadvertently Put Themselves In A Potentially Harmful Situation.


Almost every real estate licensee that I know or have known refers to their customers as their clients. It sounds cool.


At The Climer School of Real Estate, the best real estate school in Orlando, I hear “My client this” and “my client that” all the time. It is something that you are definitely tested on if you want to pass your real estate exam at Pearson Vue.


The problem is according to Florida statute Chapter 475, they don’t have clients. What they have our customers. This is something that is taught in our real estate class every day.

And according to Florida statute Chapter 475, there is a gigantic legal difference between the two. In my opinion, and I am not an attorney although I do love Erin Reagan, I believe that most licensees are putting themselves in a potentially dangerous legal situation. I believe this because of how litigious our society is and because I believe that there are many consumers out there who get their jollies from trying to “catch” and trick“ real estate agents into doing something wrong.


In Florida statute Chapter 475.278 there is something called Authorized Brokerage Relationships. In Florida real estate, there are three of these relationships. The Florida Division of Real Estate (DRE) and the Florida Department of Business and Professional Regulation (DBPR), and the Florida Real Estate Commission (FREC) all know these as well.

Unit 4 Authorized Brokerage Relationships, Customer vs. Client


The most common is called a Transaction Broker Relationship. In chapter 475(1)(b), it is presumed that all licensees are operating as transaction brokers.


This means that as soon as a licensee is having a conversation with a consumer or a member of the general public, and that consumer or member of the general public discloses some meaningful or confidential information about the real estate in the real estate needs, the transaction broker brokerage relationship has now been created.


One of the important issues that we tried to emphasize of the Climer School of Real Estate that I believe is not emphasized at many others real estate schools is that because the broker owns and controls everything, this brokerage relationship is between the broker and that consumer. The two of them may be in 1000 miles apart. The two of them will probably never meet. But they are in a Florida brokerage relationship.


The Brokers’ licensed Associate is legally a fiduciary general agent representative of their employing broker. This means that they now know that consumer they are talking to the same duties and obligations that Chapter 475 says their broker those that consumer.


When you are in a transaction broker brokerage relationship, according to Florida statute Chapter 475 you have a customer. You owe a customer and limited representation.

Transaction Broker has 'Limited' Responsibilities

Florida statute Chapter 475.01 (1)(d) further defines customer to mean “a member of the public who is or may be a buyer or seller of real property and may or may not be represented by a real estate licensee in an authorized brokerage relationship.”

Transaction Broker has a Customer, not a Client or a Principal

It is also my opinion the most real estate agents spend their entire career as a transaction broker without even knowing it. Most of them are never in a fiduciary Single Agent Brokerage Relationship.


F.S. 475.278 (3) talks about another brokerage relationship called a Single Agent Relationship. This is a fiduciary relationship.


F.S. 475.01 (1)(f) defines “Fiduciary” as “a broker in a relationship of trust and confidence between that broker as agent and the seller or buyer as principal. The duties of the broker as a fiduciary are loyalty, confidentiality, obedience, full disclosure, and accounting and the duty to use skill, care, and diligence.”.

Single Agent has a Client or a Principal, not a Customer

If you pursue the legal definition of a ‘principal’ in a Fiduciary relationship, for example in www.BusinessDictionary.com, a principal is the same thing as a client.


When you have a client or a principal, you will than the fiduciary duties of 100% confidentiality, 100% obedience, 100% loyalty, and 100% for full disclosure.

Single Agent has 100% Fiduciary Responsibilities

You now are legally required to put your client’s or your principal’s best interest is your number one pride of your own best interest. You are legally required to do when they ask you to do as long as not an illegal request.


What licensees don’t realize is that when you refer to your customer as your client, you are possibly creating a single agent fiduciary relationship with your words and actions. If you are involved in a residential sale, you have not disclosed it properly. Regardless of what type of actual transaction you are engaged in, you are not treating your ‘customer’ as a fiduciary principal. I believe that there is a possibility that either of these could come back to haunt you.


The other thing that I hear newer agents doing all the time is promising their new prospects and customers that they will be there for them 100%.


Although I also believe that the intentions are wonderful, legally you are not there for your customers ‘100%’. If you were, then you would be in the Single Agent Fiduciary Brokerage Relationship. Again, you are possibly creating a single agent fiduciary relationship with your words and actions.


Lastly, I was talking to a Broker of a large real estate company who told all of this broker’s agents that they were all operating as Single Agents and to have their customers sign a ‘Consent To Transition To Transaction Broker’ Disclosure at their very first meeting. This Broker teaches them that this is the best of both worlds and to use the consent to transition form whenever they need it.


As a friend, I did tell this Broker that this is not correct and that they were violating FS 475 in a few ways. I am not sure that this Broker believed me or changed this. However, this is not the correct use of the relationships nor the form.


More proof the almost no licensee truly understands the Broker Relationships in Florida Real Estate.


Just keep in mind that if you do find yourself in front of The Florida Real Estate Commission for discipline because your customer or your client turned in a formal complaint on you, the worst thing that you can ever say is “I did not know.”
